Files in Category:NBC Nightly News logos[edit]

These don't seem to be the best-quality versions of these NBC Nightly News logos. The November 2004 one in particular seems like an unofficial recreation — the "with Tom Brokaw" seems too small compared to the logo shown on the anchor desk monitor in this 2004 photo. (They also aren't CC-licensed "own works" beyond the recreation factor, though they may be below TOO anyway.)

  •  Comment. It was only the current revision that was empty. I have reverted the file to a non-empty state so that it can be evaluated more easily. If we are talking only scope reasons, however, the file is currently in use on Wikidata. It seems to be some sort of old document in Urdu. It would probably be good if someone who was able to read Urdu could evaluate this. IronGargoyle (talk) 04:42, 4 February 2024 (UTC)Reply[reply]

File:Ayala MRT station exterior.jpg[edit]

Copyrighted work of architecture, in a country that does not have Freedom of Panorama for free uses of Philippine works of art made by sculptors/muralists/architects who died less than 50 years ago. Several images of this building were deleted before. Unless the Congress passes House Bills 799, 2672, and 3838 (or a consolidated House Bill thereof) as well as Senate Bill 2326 (all are pending since 2022/2023, bills to amend copyright law and containing FoP provision), this image remains unfree to be commercially distributed and must be deleted. Undelete/restore this if our copyright law (R.A. 8293) has been modified accordingly. JWilz12345 (Talk|Contrib's.) 03:46, 28 January 2024 (UTC)Reply[reply]

To be clear, I have no intentions of violating intellectual property laws. My intention was to provide a decent quality picture of public infrastructure. Delete it if you must. I hope we get freedom of panorama here in the Philippines. The lack of it prevent us photographers from doing what we can to help. However, there is a similar file which has not been nominated for deletion. PhiliptheNumber1 (talk) 12:58, 28 January 2024 (UTC)Reply[reply]
@PhiliptheNumber1 the file in question was not categorized at the station's category. I'll nominate it. JWilz12345 (Talk|Contrib's.) 16:09, 28 January 2024 (UTC)Reply[reply]
@PhiliptheNumber1 additionally, it is always possible for one of the 3 House bills (or a consolidated House bill thereof) as well as Sen. Loren Legarda's bill to be passed...well hopefully the current chaos in our bicameral legislature ends soon. JWilz12345 (Talk|Contrib's.) 11:29, 29 January 2024 (UTC)Reply[reply]

Files uploaded by Ottawa-pride (talk · contribs)[edit]

Based on the identification given in the file descriptions, none of these files were created by the uploader, and almost certainly none of them are in the public domain.

Images are all described as "Courtesy of" some source. But this is just how this user identifies sources. File:Rare-cancer-seen-in-41-homosexuals-1981-07-03.png, for example, is a scan of a (clearly copyrighted) page from a 1981 issue of the New York Times. It is not in the public domain, and it is only "courtesy of" the Times in the sense that the Times put it out into the world.

Of the remaining files uploaded by the user, all are photos from Canada from the 1970s and 1980s. Obviously, none of the photos were taken before 1949, and none of them could have been created by someone who died before 1972, so none of them are in the public domain in Canada naturally.

  • One is a press photo from the Ottawa Citizen. No evidence of permission from this major newspaper to release under a CC BY-SA 4.0 license.
  • One photo is from the City of Ottawa archives. The City of Ottawa archives says they own the copyright to most of the photos in their collection, but they also say that they charge a fee for publication on a "per image, non-exclusive, one-time only, single language" basis only. It is highly unlikely they gave permission to dedicate to the public domain using CC-Zero if these are their policies.
  • There are a few photos from GO Info, a monthly newspaper published from the 1970s to 1990s, and/or the ArQuives. But there's no evidence that these items' copyright is owned by the ArQuives (which does not seem to claim that it owns the copyrights on images in its collection). The ArQuives does not license images in any real way to users of their web site, either.
  • In particular, for items from GO Info, since this was reportedly a volunteer publication, the copyright may not actually belong to GO Info, either. Under Canadian law, volunteers (unlike paid employees) retain their own copyrights, unless explicitly assigned.
  • CMAJ does not provide permission for anything published before 2021. Some items first published in 2021 or later are under a free CC BY license, but no earlier items are.

@Accuracy-searcher: can you please spell out the basis of your PD claim? - Jmabel ! talk 21:03, 30 January 2024 (UTC)Reply[reply]
I believe there might have been an issue with the way I uploaded it, so please go ahead and delete the file. Benjamin provided guidance on the process, and I'll follow his instructions or seek further assistance as needed. The Gays of Ottawa donated all their records and materials to the ArQuives (formerly the Canadian Lesbian and Gay Archives), and I frequently use them as a valuable resource for information and materials. Accuracy-searcher (talk) 22:00, 30 January 2024 (UTC)Reply[reply]
@Jmabel: How can I delete this image? What's the correct code to use to ensure I follow the rules? Should I use G7 for deletion? Accuracy-searcher (talk) 15:17, 7 February 2024 (UTC)Reply[reply]
@Accuracy-searcher: If you do nothing, it will be deleted in due course. If it is to be kept or restored, you'll need to provide a source ("public domain" is not a source), an author (an organization is very rarely a valid author, presumably some individual took the picture and owns any copyright), and a valid license or PD tag (the one you provided claims that you are the copyright owner and are granting a CC-BY-SA 4.0 license, which is obviously false and contradicts the claim of public domain.
The one thing absolutely not to do is to take down this copy and upload another copy with different information. If you sort out the copyright/licensing situation, but not in time to prevent deletion, then you need to go through the undeletion process to get this file restored with different information.
Aside: from this and other deleted uploads of yours, I get the sense that you don't understand much about copyrights. I strongly suggest that at the very least you give a quick read to public domain and COM:L before you do enough things wrong that you find yourself in trouble. - Jmabel ! talk 18:55, 7 February 2024 (UTC)Reply[reply]
@Jmabel: I understand and agree. I'll follow Benjamin's guidance and seek assistance as needed for any future uploads, if there are any. Thank you for your help and time; it's greatly appreciated. Accuracy-searcher (talk) 21:03, 7 February 2024 (UTC)Reply[reply]

Violation of COM:FOP US. (Oinkers42) (talk) 04:40, 28 January 2024 (UTC)Reply[reply]

  •  Keep. Actually, because the sculpture is integrated with a larger architectural work (the Disney Pop Century Resort buildings) it is subject to US freedom of panorama. The case determining this was Leicester v. Warner Bros. (see COM:FOP US). In this case, a courtyard sculptural garden which was part of a building complex was found to not be protected from 2D reproduction because it reflected the style of the larger architectural work. I think that is the case here. IronGargoyle (talk) 05:11, 4 February 2024 (UTC)Reply[reply]

This file was initially tagged by Piotr Bart as Logo (above threshold of originality) Yann (talk) 10:06, 28 January 2024 (UTC)Reply[reply]

Keep This entire logo is either text or simple geometric shapes. The logo consists simply of the black text "A P C" on a white circle, surrounded by a red circular ring containing the white text "Association les Professionnels du Catch".
Also contained in the logo are two instances of four-point stars. These are literally geometric shapes: The article w:Hypocycloid uses File:Astroid2.gif to demonstrate as much. The stars do not place this logo over the threshold of originality, and in fact we have an entire category here on the Commons dedicated to such instances: Category:Stars in logos, and more specifically Category:Four-pointed stars in logos.
Although this logo is "busier" than perhaps the average instance of a Template:PD-textlogo, it remains at its core comprised simply of only text or geometric shapes. CeltBrowne (talk) 16:02, 28 January 2024 (UTC)Reply[reply]

This file consists of the text "World Championship Wrestling", above which is the text "W W", and both above and below each are two instances of stylised "C" in a "scythe" shape. All of these are placed on an instance of a six-pointed star.
Keep This logo is entirely geometric, and in fact, I believe it could be easily constructed by a graphing calculator, or on paper simply using a ruler and a geometry compass. In fact, I believe the entire intention of the logo is to be as geometric as possible. The two instances of "W" are shaped to be as angular as possible. The six-pointed star beneath all these is another instance of a geometric shape. The entire logo, sans the text, is symmetrical (both horizontally and vertically), once again speaking to it's geometric design.
Given it's explicitly text + geometric design, it should be recognised as correctly being labelled Template:PD-textlogo + Template:Trademark CeltBrowne (talk) 16:00, 28 January 2024 (UTC)Reply[reply]

The artist who created these two 1932 German election posters, Karl Geiß, died in 1955. So contrary to claims, the posters are not in the public domain in Germany yet (and also still protected in the US), and the files should be deleted. They can be restored in 2028 (URAA).

Why can they be restored only in 2028 and not in 2026??: 70 years rule. --Fornax (talk) 14:23, 28 January 2024 (UTC)Reply[reply]
Because they are still protected until the end of 2027 in the US (see Commons:URAA-restored copyrights), and Wikimedia Commons requires files to be in the public domain both in their source country and the US (Commons:Licensing). --Rosenzweig τ 15:01, 28 January 2024 (UTC)Reply[reply]

Hi Rosenzweig,
Thanks for notifying me that this picture is not in the public domain. If it's not too much trouble, can you check my other uploads to see if they're copyrighted as well. Particularly the Hans Müller photo; it bears a resemblance to Dossenbach's, which could mean it's the same photographer, but Krauth's name does not appear on it so I can't know for sure. Earle Bartibus Huxley (talk) 21:41, 28 January 2024 (UTC)Reply[reply]
I already checked them. Most are from the same publisher, probably the same postcard series, but I couldn't find a named photographer for the others. The Müller one is here at the Bavarian State Library; while no photographer is named, there is a note about this photo having the Signatur (call number) "Fotoarchiv Hoffmann B.4". So it may have come from the Munich studio of Heinrich Hoffmann. Not sure if Hoffmann was the actual photographer though. --Rosenzweig τ 21:55, 28 January 2024 (UTC)Reply[reply]
I see. Thanks for checking. Should the Müller photo be deleted as well just incase, or can it be kept due to the authorship being inconclusive? I'm new to uploading images, so I don't know what the procedures are for this type of situation. Earle Bartibus Huxley (talk) 22:46, 28 January 2024 (UTC)Reply[reply]
It's not an absolute must to have them deleted without some significant doubt about them being free. For newly uploaded files, the uploader can ask to have them deleted again though, within a week of uploading (COM:COURTESY). --Rosenzweig τ 23:03, 28 January 2024 (UTC)Reply[reply]
PS @Earle Bartibus Huxley: If you want the images just for the English Wikipedia, you can upload them locally there. This one should be ok there with the templates {{PD-US-expired}} and {{Do not move to Commons|reason=US only|expiry=2026}}. --Rosenzweig τ 06:33, 30 January 2024 (UTC)Reply[reply]
Thanks for letting me know about that @Rosenzweig. I think I'll keep the Müller photo up though, considering we can't identify the photographer as of yet. I think I also might insert the other photos I've uploaded onto their respective non-English articles as well, because they too don't have pictures.
Just incase I've misundertood, do you mean I can upload the Dossenbach photo on the English wiki, providing I use those templates you've mentioned, or were you just refering to my other uploads? Earle Bartibus Huxley (talk) 23:16, 31 January 2024 (UTC)Reply[reply]
@Earle Bartibus Huxley: I was specifically referring to the Dossenbach photo, but since they were all apparently published ca. 1917, all of them should be fine for en.wp. In US copyright, anything published before 1929 (as of this year, it goes up one year each New Year's Day) is in the public domain. --Rosenzweig τ 06:36, 1 February 2024 (UTC)Reply[reply]
That's handy to know. How do I upload a picture locally to the English wikipedia? I found a file that appears to be on the wikipedia mainspace (this) is this an example of what you've said? Earle Bartibus Huxley (talk) 21:48, 1 February 2024 (UTC)Reply[reply]
en:Special:Upload. I recently uploaded en:File:Leon Amar - The Evening News ca 1910.jpg, you can look at the source text of that one and copy/adapt it for your upload. --Rosenzweig τ 07:53, 2 February 2024 (UTC)Reply[reply]
Thanks, that helps a lot.
Would it be okay if I upload the cropped version I made? or does it have to be the original, uncropped photo? I'm only asking because I prefer the former due to it not having text on it. If I'm strictly required to upload the original photo then I don't mind.
Also, should I wait til these photos get deleted from the commons first. Earle Bartibus Huxley (talk) 22:31, 2 February 2024 (UTC)Reply[reply]
Either version should be ok, though I think uploading both would be preferrable for sourcing reasons. You can also upload the uncropped version first, then the cropped version with the same file name as the uncropped one (confirm warnings), then you'll have two file versions of the same file with the later one the one being shown when used in an article. You won't be able to use the exact same file name though while there is a file with that name here at Commons, only en.wp admins can do that. So you can either upload using a (slightly) different file name or wait for the deletion of the Commons file. --Rosenzweig τ 11:34, 3 February 2024 (UTC)Reply[reply]
Cheers. I think I'll wait. I presume a deletion nomination on the commons lasts the same time as a deletion request does on wikipedia (7 days). If so, the photos will be deleted from the commons tomorrow and I can then reuse the file names. Earle Bartibus Huxley (talk) 12:55, 3 February 2024 (UTC)Reply[reply]
Deletion requests here usually can be closed after 7 days, but it might take longer. There's one DR from October 2023 still open, 236 from November, over 600 from December. There are 200+ DRs here daily, and it takes a while to decide the more complicated ones. --Rosenzweig τ 15:26, 3 February 2024 (UTC)Reply[reply]
I see. I'll get started then. I've renamed both fils to "Aviator_Albert_Dossenbach". I'll message you back when I've done it just to make sure I've done it right. Earle Bartibus Huxley (talk) 12:42, 4 February 2024 (UTC)Reply[reply]

  • US Copyright law has USA law taking precedence if it was made public in the USA in the same year. Should we assume that since it is in a USA archive it was made public in the USA in the same year, as a postcard in circulation? --RAN (talk) 22:18, 28 January 2024 (UTC)Reply[reply]
That is published simultaneously (or within 30 days), not "made public in the USA in the same year". Those postcards were published in Germany at the time of the First World War. I don't see any evidence that the postcards were simultaneously published in the US. Simultaneous publication happened somewhat frequently for English language books that were published at about the same time in the UK and the US. It's rare for anything else. --Rosenzweig τ 23:03, 28 January 2024 (UTC)Reply[reply]
Simultaneous publication is not that uncommon for sheet music, either, which was often made available through the publisher's American affiliate. It was not at all common for wartime postcards. However, it is in the public domain in the US (just not because it was published simultaneously). D. Benjamin Miller (talk) 21:18, 4 February 2024 (UTC)Reply[reply]

@Sikander Does there to seem to be a problem only with this image in particular? As far as I know, the images from the European Commission are all to free to use and redistribute, are they not? Hundreds of them have been uploaded to Commons, including a lot of them uploaded by myself. It says on the right side that the source is the EC - Audiovisual Service. Bakir123 (talk) 16:08, 28 January 2024 (UTC)Reply[reply]

Hi @Bakir123: This particular image seems problematic because the metadata for this image file (scroll to the bottom) says Copyright holder: AFP, Credit/Provider: AFP, Source: AFP.
Compare this to other EC files such as File:Elisa Ferreira 2022.jpg where we have: Credit/Provider: EU/Elisabetta VILLA, Source: European Commission, Copyright holder: © EU
It seems like Audiovisual Service posted the file but did not license it properly // sikander { talk } 🦖 23:56, 29 January 2024 (UTC)Reply[reply]
@Sikander Oh I see. Well that's a bummer. Is there still a possibility for the image to stay on Commons? If it can be deemed as a mistake, does it get a bit more weight to it (knowing that practically every image that the EC posts is free to use)? Bakir123 (talk) 10:05, 30 January 2024 (UTC)Reply[reply]

French photographer Boris Lipnitzki died in 1971, so these 1950, 1960, and 1970 photographs are still protected by copyright in both France and the US, and the files should be deleted. They can be restored when their US copyrights will have expired, in 2046, 2056, and 2066.

Hello, @Rosenzweig, I think Gene Yurre's family has the rights of the first two photographs. They used the first one in a book (Gene Yurre bidegilea: dantzaren menturan, denboraren mugan 1928-2008). However, I spoke with Gene Yurre's son, and it seems to be too difficult now to join all the family and to prove anything about the rights. Then, as we can not prove it, I think you can remove Gene Yurre's two photographs. I removed yesterday the use of these two pictures in Basque Wikipedia. Regards. "Use of the Seal - Restrictions under the law
Secretary Hobbs grants and denies permission to use the Great
Seal of the State of Arizona under A.R.S. § 41-130 which states, “41-
130. Use of state seal restricted; violation; classification
A person may use, display or otherwise employ any facsimile,
copy, likeness, imitation or other resemblance of the great seal of this
state only after obtaining the approval of the secretary of state. The
secretary of state may grant a certificate of approval upon application
by any person showing good cause for the use of the great seal of this
state for a proper purpose. The great seal of this state shall in no way
be employed by anyone other than a state agency for the purpose of
advertising or promoting the sale of any article of merchandise what-
ever within this state or for promoting any other commercial purpose.

seal of this state or any facsimile, copy, likeness, imitation or other
