The picture of Ray Charles is certainly above the threshold of copyrightability (making this a derivative copyright violation).
However, while I'm here, is the generic Pepsi can design itself copyrightable (i.e. are half the entries in Category:Pepsi_cans copyvios, or is it below threshold of originality?) If so, we should probably be looking to delete more than just this example alone. Ubcule (talk) 13:30, 10 August 2019 (UTC)

- @Asclepias: ; Thanks, that's the clarification I was looking for. While I had no doubt that the Pepsi logo was trademarked(!), I'm aware that we don't prohibit upload on the basis of trademark status in itself, and was solely concerned as to whether we'd decided it was copyrightable too.
- (That's not to say I entirely agree with the trademark policy personally- even if I understand the rationale- but it is what it is, and not something I intend to argue here.)
- At any rate, since the Ray Charles photo *is* certainly copyrightable, this means we could keep the image by cropping it (even if that defeats the original reason for its upload). Ubcule (talk) 19:00, 10 August 2019 (UTC)

- Comment - @ARMcgrath: commented at my talk page:- "If I were to upload a new update on the Pepsi ray charles with ray Charles would that save the photo from deletion?". The answer (if I understand you correctly) is no. The problem is with the original Ray Charles itself, as it's presumably copyrighted, and remains copyrighted even if it's copied via a photograph.
